DECISION & REASON:
--In race 8 a protest was lodged by the connections of ELDERAIN placed 4th by the Judge against RIVER CHIEF placed 3rd by the Judge. The margin between 3rd and 4th was a neck.
----Mr McQuade on behalf of Mrs McQuade with the use of the video gave evidence of the inward movement of RIVER CHIEF in the straight closing an opening for ELDERAIN and causing a check. ELDERAIN had moved outwards from behind CRUNCHER and was attempting a forward move.
--The rider of ELDERAIN, Cameron Lammas, agreed with the evidence presented by Mr McQuade.
----Mrs Thornton, rider of RIVER CHIEF, in evidence stated that the closing of the gap was as a result of CRUNCHER moving out.
--Mr Coles, Stipendiary Steward, stated that although RIVER CHIEF improved after the check and then was not improving at the finish.
----The Panel considered that the check to ELDERAIN was primarily caused by the outward movement of CRUNCHER and that although some minor interference was caused by RIVER CHIEF it was not sufficient to relegate RIVER CHIEF. The protest was dismissed and placings stand as called by the Judge.
