DECISION AND REASONS:
--Following the running of Race 7, Metalcraft Roofing & Resource Recycling Technologies Akaroa Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr T S Chmiel, alleging a breach of Rule 869 (6) (b) & (c) in that Mr Chmiel, as the driver of POCKET BOY in the Race, shifted KIP ROSS (L F O’Reilly) wider on the track with 1400 metres to run.

Mr Chmiel had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Mr Ydgren, Stipendiary Steward, showed a video replay of the incident. He pointed out Mr Chmiel racing in the 2-wide line, with approximately 1400 metres to run, following GREAT BALLS A FLYIN (S P Walkinshaw). He also pointed out Mr O’Reilly commencing a run 3-wide on KIP ROSS. Mr O’Reilly got up outside Mr Chmiel before Mr Walkinshaw moved out to 3-wide. At that point, Mr Chmiel followed Mr Walkinshaw out, without regard to Mr O’Reilly moving forward. As a consequence, Mr O’Reilly was forced to race 4-wide. The back straight video replay clearly showed Mr O’Reilly racing 4-wide.

Mr Escott informed the Committee that Mr Chmiel had not breached the Rule within the previous 12 months. He submitted that the Committee should have regard to Mr Chmiel’s admission of the breach and recommended a fine of $200.

The Committee took into the account the matters advanced by Mr Escott and fined Mr Chmiel the sum of $200.
