DECISION AND REASON:

The Information alleges that TJ Russell made a celebratory gesture prior to the winning post.

--

Mr Russell admitted the breach and was present at the hearing.

--

The rule was read and Mr Russell acknowledged he understood it.

--

A film was then shown of the alleged incident, the film clearly showed Mr Russell making the alleged gesture well before the winning post.

--

Mr McCutcheon explained to those present the reasons for the rule, namely safety to both horse and rider.

--

The Chairman asked Mr Russell had he ever been charged under this rule before for the same breach, he could not remember.

--

Mr McCutcheon was however able to tell the Committee his records showed that Mr Russell was charged with the same breach once in 2000 in Gisborne. Mr Russell, when asked, confirmed that was correct.

For his part Mr Russell said he understood why the rule was there and would not be doing the same again.

--

Prior to arriving at a penalty the Committee took into account all of the evidence and the fact that Mr Russell had admitted the breach. These factors however, were out weighed by the fact Mr Russell had let go the reins someway before the winning post, was a senior rider, and could have lost control of his mount. The penalty must reflect how seriously the Committee considered the breach.

A fine of $350 was imposed.
