Following Race 4 an information was filed pursuant to Rule 871 (1) (d) by Stipendiary Steward Mr J Oatham. He alleged that Mr P Boylan, rider of WAR DANCER, permitted his mount to shift inwards near the 1600 metres when not sufficiently clear of MONTJEE

Following Race 4 an information was filed pursuant to Rule 871 (1) (d) by Stipendiary Steward Mr J Oatham. He alleged that Mr P Boylan, rider of WAR DANCER, permitted his mount to shift inwards near the 1600 metres when not sufficiently clear of MONTJEE, ridden by J Riddell, forcing that runner in onto WILLANDRA PRINCE, ridden by L McFarlane, who was forced into the line of ALATRA, ridden by G Walsh.
--Mr Boylan admitted the charge.
--Stipendiary Steward Mr A Coles demonstrated the video films and showed where on the point of the turn and near the 1600 metre mark Mr Boylan, rider of WAR DANCER, allowed his mount to move in and take the line of MONTJEE, ridden by J Riddell, when insufficiently clear. This caused further tightening to WILLANDRA PRINCE, and ALATRA, on the rail, which received quite a sharp check.
--Mr Oatham, when asked for submissions on penalty, said Mr Boylan had incurred only 2 charges in the last 12 months. He also said this offence was at the lower end of carelessness.
--Mr Boylan submitted his upcoming commitments and said he intended to ride in the South Island in the coming days. He also asked for a deferment until after the Te Rapa meeting on 30 April where he had several rides.
--PENALTY :
--The Committee considered all submissions and before imposing a penalty took into account the following :

- Mr Boylan's good record. --
- His early admission of guilt. --
- The degree of carelessness which we consider low, as the inward movement was not great, but gradual and over some distance. --
- Mr Boylan's request for a deferment of his penalty.
Accordingly, the Committee imposed a suspension to be served by Mr Boylan starting after racing on 30 April and to conclude after racing on 8 May 2008 - 4 days.
