Following the running of race 10 an information was lodged by the Stipendiary Stewards alleging a breach of Rule 864 (2) (e) alleging that horseman A Lowe, (BLOWHARD), failed to activate the removable earplugs.

The Stipendiary Stewards advised that on return of BLOWHARD to the bird cage Mr Lowe was questioned by the Stipendiary Stewards regarding the non activation of the removable hood. The Stipendiary Stewards were told by Mr Lowe that he had pulled the wrong cord and therefore failed to activate the removable hood.

From a perusal of the information the Committee notes that Mr Lowe admitted the breach in writing and did not wish to be heard. The charge is accordingly found proven.

The Stipendiary Stewards advised that Mr Lowe had not been charged with a breach of this rule in the last 12 months and recommended a fine only.

The Committee, after giving consideration to the offence, Mr Lowe’s past record and his frankness with the Stipendiary Stewards imposes a fine of $100.00.
