--Stipendiary Steward Mr N. M. Ydgren has asked the Committee for a ruling as to whether the all weather track is suitable to race on at today’s meeting.
--The Information reads as follows.
--“I, the above named informant hereby apply to the judicial committee and seek a ruling on the following matters: I request that the JCA deem whether the all weather track be suitable to race on at today’s meeting.”
--Rule 1112(4) provides as follows.
--“(4) The Judicial Committee may rule on the matter referred to it in any such information and its ruling shall, subject to appeal to an Appeals Tribunal, be binding on all persons and others to whom these Rules apply.”
--Present at the hearing were the following persons.
--Mr M. McDonald from the TAB.
Mr B. Forbes the Raceday Secretary.
Mr D. Hunter the General Manager of Waterlea Properties.
Mr J. M. Rogers the trainer and driver of “DJ Hanover”.
Mr K. D. Townley the trainer and driver of “Mister Fantasy”.
Mr C. D. Thornley the driver of “Ywero Dreamer”.
Mr P. F. Kerr the driver of ”Rob Around Town”.
Mr J. R. Reedy the trainer and driver of “West Texas Rule”.
Mr P. F. O’Brien the joint trainer of “Van Esteem”.
Mr M. J. O’Brien the other joint trainer of “Van Esteem”.
Mr Ydgren gave evidence that the all weather track had been inadvertently watered when the grass track was watered overnight. This had resulted in some parts of the track being softer than others, and there was also a problem with dark patches on an otherwise light coloured track. It was feared that horses might try and jump these dark patches, thereby causing a safety problem.
--All persons present were given the opportunity to put forward their views on this matter. There were concerns by some persons present that the track might be unsafe for the reasons outlined by Mr Ydgren. However some were of the view that the track would be safe to race on.
--There were suggestions that the two harness races could be switched to the grass track, or that the harness races could be deferred to later in the day to allow the track to dry out. It was quickly concluded that neither of these suggestions was possible.
--It was then agreed that a possible solution was to have the track watered to eliminate the dark patches. All drivers would then do their preliminaries on the track in the usual way, and give an assessment of the track just before the race was due to start.
--The hearing was then adjourned.
--We then went out to the track with Mr Ydgren. During their preliminaries some of the drivers were asked by Mr Ydgren for an assessment of the safety of the track, and all persons spoken to (not all the drivers) said that the track was safe to race on.
--We had a final discussion with Mr Ydgren and it was agreed that all drivers were to be told at the assembly area (mobile start race) that they had the option of late scratching their horse if they had any safety concerns. No drivers took this option, and both races were run as programmed.
