Decision:

Following the running of Race 4, Peruvian Hanover Stands at Wai-Eyre Farm Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Graduation Driver, Mr R J Austin, alleging a breach of Rule 869 (2) (a) in that Mr Austin, as the driver of CUE in the Race, used his whip excessively in the run home.



Following the running of Race 4, Peruvian Hanover Stands at Wai-Eyre Farm Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Graduation Driver, Mr R J Austin, alleging a breach of Rule 869 (2) (a) in that Mr Austin, as the driver of CUE in the Race, used his whip excessively in the run home.

Mr Austin had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 (2) (a) provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.

Mrs K R Williams, Stipendiary Steward, showed a video replay of the final 300 metres of the Race. She pointed out Mr Austin on CUE, challenging 3-wide, commence using his whip shortly after straightening and continue to use it until the finishing line, on a total of 26 occasions, she alleged. Mrs Williams said that Mr Austin had stated that, half way down the straight, he realised that he was using the whip too much but, by that time, it was too late as the horse was continuing to run on. The Committee noted that CUE had finished 2nd in the Race, beaten by a short head.

Mrs Williams informed the Committee that Mr Austin had no breaches of the Rule in the past 12 months. She recommended a fine of $250.

In determining penalty, the Committee took into account Mr Austin’s admission of the breach and his good record.

Mr Austin was fined the sum of $250.
