Following the running of Race 7 the Group 3 Manawatu Cup Mr. E. Dalley was charged with a breach of Rule 648 (5) in that he weighed in 1 kg in excess of his weighed -out weight.

Following the running of Race 7 the Group 3 Manawatu Cup Mr. E. Dalley was charged with a breach of Rule 648 (5) in that he weighed in 1 kg in excess of his weighed -out weight.

Mr. Dalley admitted the breach and was represented by Mr. Paul Mirabelli.

--

Mr. Oatham told the committee that Mr. Dalley had no explanation for weighing in one kilogram over his weighing-out weight.  He was engaged for RANGINUI at 52kgs and was ½ kg over that weight prior to the race but was a full kilogram over when he weighed in.

--

Mr. Dalley reiterated that he could offer no explanation for the weight discrepancy. The addition of a girth sleeve was mentioned but that alone could not be held responsible for the difference.

--

In coming to a decision on penalty we took into account all of the submissions including Mr. Dalley’s admission of the breach and his clear record.

--

Previous breaches of this particular rule have incurred fines of $200 however because this breach occurred in a Group 3 race we have viewed it slightly more seriously.
 
Mr. Dalley is therefore fined the sum of $250.00.
