DECISION & REASONS

An Information was lodged by Stipendiary Steward Mr JM Muirhead against horseman GM Smith, the driver of THE ADMAN, alleging the breach of the above law ? careless driving ? in that he drove THE ADMAN carelessly, tightening HARRY KAY (IJ Brownlee driver) causing it to be checked which in turn caused interference to READY FOR BATTLE (G Wolfenden driver) racing into the first bend. Mr Smith admitted the breach of the law and was present at the hearing.

The relevant Rule was read to Mr Smith and he acknowledged understanding it.

By agreement the evidence presented in the protest hearing in relation to the second placing of THE ADMAN was accepted as evidence at this hearing.

PENALTY
The parties were asked for suggestions as to penalty and Mr Muirhead said that this incident was in the mid to upper range of seriousness and he sought a suspension of Mr Smith's horseman's licence for a period of three days.

Mr Smith stated that he would prefer to be fined rather than suspended because he is new to the North Island racing scene and he is trying to obtain regular drives. If he was suspended, he would probably lose drives that he already had and this would have an extra impact on him.

Mr Muirhead thought that because of the nature of the offence that if there was to be a fine, it should be in the order of $750.00.

I told Mr Smith that I would deal with this matter by way of a fine, but that if he was to face a similar charge in the near future, then he would certainly face suspension of his horseman's licence. I told him that the fine would have to be substantial.

I do, however, give Mr Smith credit for admitting the breach and, accordingly, I impose a fine of $640.00 on him.
