Following the running of Race 2, Clock Tower Motors Limited Fillies & Mares Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mr N M Ydgren, against SONG FOR THE ASKING (C J De Filippi), placed 4th by the judge, on the ground of “breaking from its gait over the final stages”.
--Mr T J Grant, part-owner and trainer of SONG FOR THE ASKING, had endorsed and signed the information form “I do not contest the protest”.
--Stipendiary Steward, Mr S P Renault, showed a video replay of the final stages of the Race. He pointed out SONG FOR THE ASKING break from its gait inside the final 50 metres and continue to a gallop to the finishing line. It finished in 4th placing and, Mr Ydgren alleged, it was lapped on by the 5th horse, TALASPRING and the 6th horse, FORWARD PASS. Mr Ydgren sought relegation of SONG FOR THE ASKING to 6th placing under the lapped on Rule.
--The Committee was satisfied from the video evidence that SONG FOR THE STARS had broken from its gait inside the final 50 metres of the Race and was still not in its correct gait when its nose reached the finishing line. It was lapped on by the 5th and 6th runners, both of which were in their correct gait. The Committee also noted that Mr Grant did not contest the protest.
--Accordingly, the protest was upheld and SONG FOR THE ASKING was relegated to 6th placing. Consequent upon the relegation, the amended placings for the Race are as follows:
--
1st 7 So Free
2nd 3 Relentless Storm
3rd 2 Bonnie Ballymena
4th 12 Talaspring
5th 11 Forward Pass
6th 10 Song for the Asking.
