On Saturday, 2 May 2009, Mr Morley was the trainer of LACHLAN JACK in Race 3 at the meeting of Invercargill Harness Racing Club at Ascot Park Raceway, Invercargill. The horse raced with removeable earplugs which had not been notified to Harness Racing New Zealand.  The matter was only reported to Stipendiary Stewards after completion of the day’s racing.

On Saturday, 2 May 2009, Mr Morley was the trainer of LACHLAN JACK in Race 3 at the meeting of Invercargill Harness Racing Club at Ascot Park Raceway, Invercargill. The horse raced with removeable earplugs which had not been notified to Harness Racing New Zealand.  The matter was only reported to Stipendiary Stewards after completion of the day’s racing.

The General Manager of Harness Racing New Zealand subsequently gave written permission, pursuant to Rule 1104 (4) (c), for an information to be filed.

Information 66871 was duly filed and served on Mr Morley at the meeting of New Zealand Metropolitan Trotting Club on 15 May 2009 and was heard on that date.  It alleged as follows:
“That C D Morley failed to notify Harness Racing New Zealand that LACHLAN JACK was to race with removeable earplugs”.

Rule 865 provides as follows:
(2) A horse may race with different gear from its last start when the owner, trainer or person in control of the horse has notified the change in the manner prescribed in the Approved Gear Regulations. Any such change is to be advised not later than the official time for notification of drivers as specified in the Notification of Drivers Regulations.

Mr Morley had indicated on the information form, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information.

The charge was found to be proved and Mr Morley was fined the sum of $50.
