Decision:

Following race 4 an Information was filed pursuant to Rule 876(1). The informant was Mr A Coles, Stipendiary Steward, and the defendant was Mr M Baker, trainer of the second horse SLAVADAAD.

Following race 4 an Information was filed pursuant to Rule 876(1). The informant was Mr A Coles, Stipendiary Steward, and the defendant was Mr M Baker, trainer of the second horse SLAVADAAD.

All connections were advised of the protest.

Also present at the inquiry was Mr D Walsh, rider of SLAVADAAD, Miss S Collett, rider of the fourth horse MAGIC SUN, and the trainer of that horse Ms K Fursdon.

The informant, Mr Coles, alleged that SLAVADAAD placed second by the Judge interfered with the chances of MAGIC SUN placed fourth by the Judge. This was alleged to have occurred in the final straight.

Mr W Robinson, Assistant Stipendiary Steward, demonstrated the video films and showed that at approximately the 200 metre mark SLAVADAAD ducked out sharply and in doing so took the line of MAGIC SUN. This was pointed out to the Committee on the head-on video. He said in his opinion MAGIC SUN was making ground at the time, but as a result of the interference had to be checked. He believed it definitely cost MAGIC SUN third placing.

Miss S Collett, rider of MAGIC SUN, said in her evidence that she had a clear run to the finish line, but then was checked sharply due to the outward movement from SLAVADAAD, and her mount lost momentum.

Ms K Fursdon, trainer of MAGIC SUN, said MAGIC SUN was a big horse with a big stride and the interference cost him considerable momentum.

Mr D Walsh, rider of SLAVADAAD, said in his opinion that although he did move out he said he was 2 lengths clear of MAGIC SUN when the interference took place.

Mr M Baker, trainer of SLAVADAAD, said he agreed with Mr Walsh's evidence by saying his horse was 2 lengths clear when moving out into MAGIC SUN?S line.

Mr A Coles in his summing up said that SLAVADAAD was not 2 lengths clear of MAGIC SUN when taking that horse's line.

The Committee carefully considered all the evidence and repeated viewing the relevant videos. We are satisfied that interference did occur at approximately the 200 metre mark when SLAVADAAD moved out sharply into the line of MAGIC SUN.

We are clearly of the view that the chances of MAGIC SUN finishing in a better place were affected.

In applying our discretion we took the following into account:

• SLAVADAAD was not the required distance clear when moving into the line of MAGIC SUN.

• The margin at the post between third and fourth was only a short neck.

• The momentum lost by MAGIC SUN and the strong manner in which he finished the race to the line.

Because of these reasons we uphold the protest and the Judge's placings shall now be:

11 EIGHT BELLES first

3 DASHBOARD LIGHT second

8 MAGIC SUN third

2 SLAVADAAD fourth

14 MAIORO?S PRINCESS fifth
