Following the running of race No 9 information was filed instigating a protest the informant was Mr J M Muirhead stipendiary steward and this protest was against horse No 4 Cracker Kari placed 3rd by the judge

Following the running of race No 9 information was filed instigating a protest the informant was Mr J M Muirhead stipendiary steward and this protest was against horse No 4 Cracker Kari placed 3rd by the judge. The information alleged that Cracker Kari was in breach of rule 870 and the breaking Horse regulations in that this horse galloped over the last 70 meters of this race and was in a break over the finishing line.

The judges placings were 1st No 5, 2nd No 7, 3rd No 4, 4th No 2, 5th no 6, 6th No 1.

Present at the hearing and representing the connections of Cracker Kari was Mr Paul Green the trainer of this horse.

Mr Muirhead showed the video of the latter stages of this race and the video was clear that Cracker Kari which was racing up the passing lane was under a drive and broke from its gait and galloped over the line when in 3rd place Mr Muirhead stated this was in contravention of rule 870 and also that Breaking Horse Regulations.

Mr Green on viewing the video was asked by the chairman if he wished to contest this protest, as Cracker Kari was in a break for the last 70 meters of this race.

Mr Green stated he did not wish to contest this protest as he understood that his horse was in breach of the rules as alleged.

Decision And Reasons.

As this protest was not contested by Mr Green the trainer of Cracker Kari the Judicial Panel upholds the protest and orders that Cracker Kari be disqualified from 3rd placing in this race.

The amended places for this race shall now be 1st No 5, 2nd No 7, 3rd No 2, 4th no 6, 5th no 1, 6th No 8.
