An Information instigating a protest was lodged by Stipendiary Steward Mr TW Taumanu against the second placing of horse number 4 Phoebe Sunset (Driver Miss N Chilcott) on the grounds of breaking free of interference and galloping for approximately 120 metres inside the last 200 metres of the race.

An Information instigating a protest was lodged by Stipendiary Steward Mr TW Taumanu against the second placing of horse number 4 Phoebe Sunset (Driver Miss N Chilcott) on the grounds of breaking free of interference and galloping for approximately 120 metres inside the last 200 metres of the race.
--The protest was contested.
--Miss Chilcott was present and she advised this Committee that she was representing the owners of Phoebe Sunset.
--Stipendiary Steward Mr TW Taumanu gave evidence from his own observations and also by use of the video film. The film showed the incident quite clearly and it showed that upon entering into the straight that Phoebe Sunset initially went into a short break and then regained its gait but that shortly thereafter it broke again and galloped for a considerable distance in the straight and only regained its gait just before the finishing line. The Stipendiary Stewards estimated that collectively Phoebe Sunset had galloped for approximately 120 metres and this was inside the last 200 metres of the race and this was a breach of the Breaking Horses Regulations.
--Paragraph (b) of the Breaking Horses Regulations provides:
--“Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.”.
--Rule 870(3) provides:
--“Any horse which breaks from its gait shall promptly regain its proper gait.”.
--At the conclusion of evidence from the Stipendiary Stewards Miss Chilcott advised this Committee that she no longer contested the protest.
--DECISION
--On the basis that this protest is now not contested the Committee upholds the protest and Phoebe Sunset is disqualified from the race. The amended placings are now:
--1st 1 (Indian Wells)
2nd 7 (Braig)
3rd 3 (Dux)
4th 2 (Endeavour)
5th 6 (Iwi Trouble)
6th 5 (Earls Lady)
