DECISION & REASON
--Following the running of Race 1, Mr T Harris the trainer of CRACKER was charged with a breach of Rule 864(2)(d). It was alleged that the nearside bandage on CRACKER malfunctioned during the running through not being applied correctly.
--Mr Harris admitted the breach, however, elected not to be present at the hearing.
--Penalty:
--It was submitted by Mr Escott that the bandage on the hind leg of CRACKER came adrift during the running and was dragging behind this horse throughout the race. Mr Escott further submitted that the standard penalty for a breach of this rule was a fine of $200 and in this case he saw no reason why this should be departed from.
--The committee finds that the accepted and usual penalty for a breach of this rule is a fine of $200, and in this case there appears no reason why this penalty should not be similarly imposed, therefore Mr Harris is fined $200.
