An information # 5521 was laid by Stipendiary Steward Mr M Davidson under Rule 330 (3) (c) alleging that Mr J Bates failed to make the carded weight for TAP ‘N’ GOLD in Race 3.

Mr Bates admitted the breach and was present at the hearing.

--

Stipendiary Steward Mr Davidson stated that Mr Bates had contacted him on the morning of race day informing him that he was unable to ride TAP ‘N’ GOLD at the carded weight.

Mr Bates stated that even though he rode work this morning and did some ‘mucking out’ work for Mr Pitman he was still overweight.  He also stated that he was only asked to ride TAP ‘N’ GOLD on race day morning.  This was not confirmed.

Mr Davidson, when asked re previous record and submissions on penalty, stated that Mr Bates did in fact have a similar charge on 21/3/10 at Gore, where he was fined the sum of $150.  Mr Davidson suggested that a fine of $150 - $250 would be appropriate.

The panel adjourned to consider their decision.

The Committee, after considering all the relevant information, imposed a fine of $200 on Mr Bates.
