Decision:

Following Race 10 an information was filed pursuant to Rule 638(1)(d).The informant, Stipendiary Steward Mr A Coles alleged that passing the 1300 metres, Apprentice Jockey Mr H. Kasim riding BEGGARS BANQUET shifted in when insufficiently clear of NOVICE MISTRESS (A Calder) placing that horse in restricted room resulting in it having to be checked by the rider.



Following Race 10 an information was filed pursuant to Rule 638(1)(d).The informant, Stipendiary Steward Mr A Coles alleged that passing the 1300 metres, Apprentice Jockey Mr H. Kasim riding BEGGARS BANQUET shifted in when insufficiently clear of NOVICE MISTRESS (A Calder) placing that horse in restricted room resulting in it having to be checked by the rider.

Mr Kasim admitted the breach and was represented by his employer, Mr D. Dwyer.

Mr Williamson demonstrated the video films which clearly showed at the 1300 metres BEGGARS BANQUET was racing in a 4 wide position when rider H Kasim allowed his mount to shift inwards when only a bare length clear at best resulting in NOVICE MISTRESS ridden by Mr A Calder having to be checked out of it.

Mr Dwyer, on behalf of Mr Kasim, said they would plead guilty to the charge and to the interference received by Mr Calder’s mount.

PENALTY SUBMISSIONS

Mr Coles said as this was Mr Kasim second charge for the day this Committee is aware of Mr Kasim’s record. He said Mr Kasim was not the required distance clear when he shifted in, he said Mr Calder’s mount was racing keenly at the time of the incident but emphasized Mr Kasim needs to be clear when shifting ground. He submitted a suspension in the range of 4-6 days.
Mr Dwyer had nothing to further to add.

PENALTY

The Committee carefully considered all evidence and submissions as presented. Mitigating factors considered were Mr Kasim guilty plea and his good record. However the aggravating factor in this case was the inward movement when only a bare length clear, causing Novice Mistress to be checked. The Committee considers, however, his carelessness was at the mid range and this was his second careless riding charge for the day. The Committee noted that Mr Kasim was under suspension starting after racing on December 5th and to conclude after racing on December 11th 2009. Accordingly after taking all the above factors into account we impose a suspension on Mr Kasim for the period from the 12th of December to 19th December 2009 both dates inclusive, effectively 5 days.
