CHARGES:

Following race 2 an information was filed pursuant to rule 638 (1) (d).  The informant Mr Williamson alleged that PETER COLADA (R Hurdle) when shifting in near the 1300 metres dictated TIMTAM LAD (R Rattley) in onto FEED BACK (J Collett) who was dictated in causing it to clip heels and blunder. 

FACTS:

Mr W Robinson demonstrated the video films which showed at a point near the 1300 metres Mr R Hurdle riding PETER COLADA move in approximately two horse widths when insufficiently clear.  In doing so Mr Hurdle moved into the line of TIMTAM LAD who in turn was forced in, taking the line of FEED BACK who clipped heels and nearly fell.

Mr R Hurdle, rider of PETER COLADA, said he didn’t make contact with TIMTAM LAD but admitted dictating its line. 

Mr P Hurdle said he was told prior to the race that PETER COLADA can be a difficult horse to ride and that following the race Mr R Hurdle told him he did not hear anyone call out.

SUBMISSION(s) ON PENALTY:

Mr Williamson said this was Mr Hurdle’s 20^th ride and his first charge.  He said the committee should consider this was an apprentice riders’ race with inexperienced riders around Mr Hurdle at the time of the incident.  Although FEED BACK blundered badly it did go on to win the race.  He submitted this was at the lower end of carelessness.

Mr Hurdle said he had commitments up to and including 25 October.

REASON(s):

The committee considered all evidence and submissions before imposing an appropriate penalty.  Mitigating factors are Mr Hurdle’s admission of the breach, his inexperience and this was his first charge.  However these must be balanced against the interference suffered by FEED BACK who very nearly fell.  Clearly Mr Hurdle moved in approximately two horse widths when insufficiently clear.  After considering all the above factors we find this breach to be at the low end of carelessness.

PENALTY:

Accordingly we suspend Mr Hurdle from riding in races which is to start after racing on 25 October and conclude after racing on 30 October (4 riding days).
