Decision: Following race 6 an Information was filed pursuant to Rule 871 (1) (d). The Informant, Mr J Oatham alleged that Miss Wenn allowed her mount EBONY DREAM to shift in 200 metres after the start causing a check to SUN VALLEY (L Callaway)
Following race 6 an Information was filed pursuant to Rule 871 (1) (d). The Informant, Mr J Oatham alleged that Miss Wenn allowed her mount EBONY DREAM to shift in 200 metres after the start causing a check to SUN VALLEY (L Callaway)

Miss Wenn admitted the breach.
Mr Williamson demonstrated the video films which clearly showed Miss Wenn shifting in and cause crowding to SUN VALLEY, when no more than ¾ length clear of that runner. This occurred 200 metres after the start.
Miss Wenn said she thought she was clear of when angling her mount in towards the rail.
PENALTY SUBMISSIONS
Miss Wenn said she had firm commitments to ride at Tauranga on 21 March 09. She confirmed to the Committee that she does not travel to the South Island to ride.
Mr Oatham said Miss Wenn had a very good record with only 1 charge in the last 12 months. He stated the interference was at the lower to mid range. He submitted a 4 day suspension would be appropriate.
PENALTY
The committee carefully considered all submissions and before imposing a penalty took into account the following:
1. Her guilty plea
2. Her very good record
3. Level of carelessness; lower range
Accordingly we impose a suspension to start after racing on 21 March and to conclude after racing on 1 April 2009 (4 Days)
