Following the running of Race 1, The Breeze Mobile Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against HOT WIRED (R A Williams), placed 1st by the judge, on the ground that it “struck pylons final bend”. Rule 869 (7B).

Following the running of Race 1, The Breeze Mobile Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against HOT WIRED (R A Williams), placed 1st by the judge, on the ground that it “struck pylons final bend”.  Rule 869 (7B).

Mr Williams, the part-owner, trainer and driver of HOT WIRED, was present at the hearing of the information.

 Rule 869 (7B) provides as follows:
Where any horse or its sulky wheel moves inside the track marker line for more than 30 metres in the last 600 metres of a race the horse shall be disqualified from that race except where it is established that the breach was caused by interference by another horse or horseman.

Mr Escott alleged that HOT WIRED had run inside at least 4 to 5 pylons – a distance of more than 30 metres. A video replay of the final 400 metres of the Race was shown. At that stage, HOT WIRED was trailing the leader on the marker line. Just prior to the home turn, with approximately 300 metres to run, the sulky wheel of HOT WIRED could clearly be seen to move inside at least 5 pylons. Mrs K R Williams, Stipendiary Steward, informed the Committee that the pylons, at that point on the track, are 9.4 and 9.5 metres apart.

Mr Williams stated that he did not contest the protest. He explained that the horse had just “ducked away” from the other horses. He did not allege that the breach had been caused by any interference.

The Committee was satisfied that the sulky wheel of HOT WIRED had moved inside the track marker line for more than 30 metres in the last 600 metres of the Race. In terms of the Rule, the Committee was required to disqualify HOT WIRED from the Race. The protest was upheld and HOT WIRED was disqualified accordingly.

Consequent upon the disqualification, the amended placings for the Race are as follows:

3rd   12    Music Box Dancer
