| ---- An Information lodging a protest was laid by Stipendiary Steward Mr J MUIRHEAD on behalf of the connections of Horse 5 CRYSTAL DESERT (Jnr Driver G NOAKES) placed 10th by the Judge against Horse 7 ASABELLA , (Jnr Driver H CULLEN) placed 2nd by the Judge, on the grounds of interference with approximately 300 metres to run in the race. ----The protest was contested and ASABELLA was represented by driver Mr Cullen and trainer Mr P BLANCHARD. ----Evidence was given by Stipendiary Steward Mr J Muirhead with reference to video tapes of the race. He was positioned at the Stipendiary Stewards Observation tower on the home turn and had a clear unfettered view of the incident. ----At about the 300 metre mark he saw Mr Hayden reach down and pull the ear plugs on Asabella. His horse moved inwards tightened and came into contact with Crystal Desert on his inside causing Crystal Desert to break up and lose all chance. ----The video tapes of the incident did not assist the enquiry apart from showing Mr Cullen reaching forward and his horse moving in on the turn into the home straight. ----Junior Driver G Noakes gave evidence of seeing Mr Cullen reaching down and shortly after Asabella moving down and striking his horses legs causing Crystal Desert to break up and lose all chance. ----He disputed being at fault and in response to questioning from trainer Mr Blanchard reaffirmed that Mr Cullen and Asabella had moved down and struck his drive causing the interference. His horse was travelling well at the time of interference. ----Junior Driver Mr H Cullen contended that the breaking of Crystal Desert had occurred free of interference and was not caused by his actions. ----DECISION ----Both Stipendiary Steward Mr Muirhead and Junior driver Noakes gave clear evidence which was to a lesser extent supported by video evidence confirming that interference had occurred to Crystal Desert and that this interference was from the actions of Asabella. ----The consequence of this interference was that Crystal Desert broke up losing all chance finally finishing at the rear of the field ----.The Protest was upheld and ASABELLA was relegated to 11th place ----Amended placings are ----1st 11 Lucky Olivia --2nd 2 Amuse Me --3rd 4 Shezgottheurge --4th 8 Vikeda --5th 10 Indiana Rose --6th 3 Vege Knight ------
