Following Race 7 an information was filed pursuant to Rule 638(3)(b).The Informant, Stipendiary Steward Mr A. Coles, alleged Ms Hercock the rider of DANA CURRAGH was outside of the acceptable guidelines over her use of the whip.

Ms Hercock admitted the breach and was present at the hearing.

The Rule 638(3) (b) was read and Ms Hercock acknowledged she understood the Rule.

Mr Coles demonstrated the video films which showed, near the 400 metre mark, Ms Hercock riding Dana Curragh was racing in second to last position under a hard ride. He counted Ms Hercock had hit her mount 14 times prior to the final 200 metres.

Ms Hercock stated her mount was flat as far as 800 metres from the finish and believed it would not have won the race had she not ridden the horse with vigour.

PENALTY SUBMISSIONS

Mr Coles said Ms Hercock had one previous charge under the rule, this was on 3.10.09 and was fined $250.00.He submitted a fine of not less than $250.00.

The Committee carefully considered the evidence and submissions presented. We did have some sympathy for Ms Hercock as her horse proved a difficult ride but reminded her this breach was clearly outside the guidelines allowed under the whip rule and this was her second charge in a month.

--

Accordingly we impose a fine of $300.00.
