Following the running of Race 7, Dominion Steel Recycling Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Junior Driver, Mr D J Dunn, alleging that Mr Dunn, as the driver of EASY ARMBRO in the Race, used his whip excessively in the run home.

DECISION AND REASONS:
--Following the running of Race 7, Dominion Steel Recycling Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Junior Driver, Mr D J Dunn, alleging that Mr Dunn, as the driver of EASY ARMBRO in the Race, used his whip excessively in the run home.
----Mr Dunn was present at the hearing of the information. He informed the Committee that he waived the right to be assisted by a Senior Horseman in the proceedings. He admitted the breach which was found to be proved.
----Mr McIntyre said that the Stewards alleged that Mr Dunn had used his whip excessively in the run home having used the whip 18-20 times in the run home.
----Mrs K R Williams showed a video replay of the final 300 metres of the Race which confirmed Mr McIntyre's allegation as to the number of occasions on which the whip had been used.
----Mr McIntyre recommended a fine of $200 or a suspension of 2 days if Mr Dunn, as a Junior Driver, was not in a position to pay a fine.
----Mr Dunn stated that the saddle on the horse had "slipped right back" to the horse's hind quarters. This was because the breastplate had not been put on the horse. Mr Dunn stated that, as a consequence of the saddle's slipping, he was unable to use the whip to strike the horse but rather was hitting the sulky shaft. He did not dispute the alleged number of strikes.
----Mr Dunn, in relation to penalty, expressed a preference for a fine rather than a suspension of his licence.
----The Committee was satisfied that a fine was appropriate for the particular breach and Mr Dunn was fined the sum of $200.
