Following the running of Race 2 information instigating a protest was lodged by Stipendiary Steward Mr N ESCOTT against Horse 7 TOHEROA (D BUTCHER) placed third by the Judge

Following the running of Race 2 information instigating a protest was lodged by Stipendiary Steward Mr N ESCOTT against Horse 7 TOHEROA (D BUTCHER) placed third by the Judge. in that during the race home part of the sulky protruded inside the marker line in excess of 30 metres

Mr Butcher appeared to represent the connections of TOHEROA.

--

Evidence was given with reference to Video tapes of the closing stages of the race which clearly showed TOHEROA travelling inside the marker line and contacting three track markers placed at approximately 18.4 metre intervals and gaining an advantage by progressing past other runners in the field.

Mr ESCOTT submitted that having travelled in excess of 30 metres inside the track marker line in the last 600 metres of the race TOHEROA had contravened Rule 869 (7B) and be disqualified in accordance with those provisions

Mr BUTCHER acknowledged the breach and conceded his horse should be disqualified.

Evidence adduced clearly indicated that TOHEROA breached the provisions of Rule 869 (7A) and (7B) and is disqualified.
