Following the running of Race 1, the TV3 4yo Diamond, an information was filed by Chief Stipendiary Steward Mr N. R. Escott against Mr A. P. Neal, the driver of TRIGIRL BRIGADE (12), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.

Following the running of Race 1, the TV3 4yo Diamond, an information was filed by Chief Stipendiary Steward Mr N. R. Escott against Mr A. P. Neal, the driver of TRIGIRL BRIGADE (12), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.
--Mr Neal had indicated on the information that he admitted this breach of the Rules and that he did not wish to attend the hearing.
--Mr Escott gave evidence and used video coverage to show that Mr Neal had used his whip on about 21 occasions in the run home.
--Penalty:
--In relation to penalty Mr Escott advised that Mr Neal had a previous conviction for a breach of this Rule on 2 February 2009 when he was fined $250-00. As Mr Neal had admitted this breach he recommended a fine of $300-00.
--Taking all the above matters into account we were satisfied that a fine of $300-00 was appropriate in this case. Accordingly Mr Neal was fined the sum of $300-00.
