Decision:

Following the running of Race 5, Midhurst Holdings Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Driver, Mr R W Curtin jnr, alleging a breach of Rule 869 (4) in that Mr Curtin “whilst driving ROYS BOY with approximately 400 metres to run shifted down the track causing LIVE N DREAM to contact several pylons and break”.

Following the running of Race 5, Midhurst Holdings Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Driver, Mr R W Curtin jnr, alleging a breach of Rule 869 (4) in that Mr Curtin “whilst driving ROYS BOY with approximately 400 metres to run shifted down the track causing LIVE N DREAM to contact several pylons and break”.

The information was filed with the Registrar on raceday and served on Mr Curtin at the meeting of New Zealand Metropolitan TC at Addington on 24 July 2009 and was heard at that meeting.

Mr Curtin had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information.

The breach was found proved accordingly.
 
Mrs Williams showed a video replay of the incident with approximately 400 metres to run. She pointed out ROYS BOY, towards the rear of the field. Immediately behind ROYS BOY was LIVE N DREAM (C D Thornley). Mr Curtin then shifted out on to the back of COSMIC DREAM which had been giving ground. Mr Curtin then shifted back down. Mr Thornley had stayed on the pylons and was tightened by Mr Curtin. Mr Thornley’s horse struck a number of pylons and broke.

Mrs Williams said that the Stipendiary Stewards were seeking a 2-week’s suspension.

The Committee, in determining penalty, took into account Mr Curtin’s admission of the breach and that the breach was, in its view, at the lower end of the scale.

Mr Curtin’s licence was suspended up to and including Thursday, 6 August 2009.
