Following the running of Race 4, Colin De Filippi ? 2005/2006 Season Drivers Premiership Winner Pace, an information was filed by Stipendiary Steward, Mr N Ydgren, against Licensed Junior Driver, Mr J R Dunn, alleging that Mr Dunn, as the driver of GIPSY MOTH in the Race, used his whip in an excessive manner over the concluding stages.

DECISION AND REASONS:

Following the running of Race 4, Colin De Filippi ? 2005/2006 Season Drivers Premiership Winner Pace, an information was filed by Stipendiary Steward, Mr N Ydgren, against Licensed Junior Driver, Mr J R Dunn, alleging that Mr Dunn, as the driver of GIPSY MOTH in the Race, used his whip in an excessive manner over the concluding stages.

Mr Dunn was present at the hearing of the information and admitted the breach. Mr Dunn is a Junior Driver and he declined the opportunity to be assisted at the hearing by a senior horseman.

Mr Ydgren showed a video replay of the final 200-300 metres of the Race. He said that the Stipendiary Stewards had counted at least 20 strikes with the whip. He said that there were a number of "fakes" or "dummy hits" which would bring the number up to about 25. This was accepted by Mr Dunn.

Mr Ydgren said that Mr Dunn had not previously breached the Rule and recommended a fine of $200.

Mr Dunn indicated that he preferred a fine to a period of suspension. He asked the Committee to take into account his junior driver status.

The Committee, in arriving at penalty, took into account the submissions of the parties, Mr Dunn's admission of the breach and his previous good record.

Mr Dunn was fined the sum of $200.
