Decision: Following the running of Race 4, the Vita Stockfoods Pace, an information lodging a protest was filed by Stipendiary Steward Mr C J Allison.  The allegation being that with approximately 500 metres to run, BEAUDINE TERMINATOR (D J Dunn) improved on the Inside of BLOWHARD (A Lowe), causing interference to BARBERINO

Following the running of Race 4, the Vita Stockfoods Pace, an information lodging a protest was filed by Stipendiary Steward Mr C J Allison.  The allegation being that with approximately 500 metres to run, BEAUDINE TERMINATOR (D J Dunn) improved on the Inside of BLOWHARD (A Lowe), causing interference to BARBERINO (M Jones) and HE’S THE MAN (N Williamson), which fell.

BEAUDINE TERMINATOR subsequently went on to win the event.

Present at the hearing were Messrs Dunn, Lowe and Jones, along with the trainer of BEAUDINE TERMINATOR, Mr G Anderson.

Video footage of the incident, taken from different angles, was shown by Stipendiary Steward, Mr P Knowles. Leading up to the incident the film shows BLOWHARD leading, BEAUDINE TERMINATOR trailing, with BARBARINO racing outside the leader and HE’S THE MAN trailing BARBARINO.

The camera positioned at the end of the back straight depicts the events from about the 500 metres most effectively. Mr Dunn is seen to elect to come off the trail and move down onto the markers when it appears that BLOWHARD moves out marginally.  Mr Lowe takes immediate action to correct his line, however with Mr Dunn now attempting to move up on his inside, Mr Lowe is pressured out into the line of Mr Jones who is checked and comes back onto Mr Williamson whose horse falls heavily.

Mr Knowles makes the assessment that Mr Dunn has moved into a position that he should not have been in.

Mr Jones stated that he was holding his line and that the leader moved out minimally, however Mr Lowe had no opportunity to correct as he now had Mr Dunn down on his inside.

Mr Lowe believed that he was doing his best to keep straight and that there just wasn’t enough room for Mr Dunn to get his wheels through the gap he was attempting to take.

--

Mr Dunn believed that there was plenty of room and that he was entitled to take the gap, a viewed shared by Trainer, Mr Anderson.

--

In summary, Mr Allison stated that it was the lead horse which determined the line which set the pattern for following horses to take up.

It was of assistance to the Committee in reaching a decision to note that the wet track showed quite clearly the sulky tyre marks depicting the running line adopted by drivers.  This confirmed the marginal amount Mr Lowe moved out, as well as establishing the fact that the running line appeared to angle in closer to the markers nearer to the bend between the 500 and 400 metre mark.

The Committee is of the view that Mr Dunn’s election to attempt to pass Mr Lowe on the inside so close to the bend was inevitably going to end with his running out of room, something which a horseman of Mr Dunn’s calibre should have reasonably foreseen.  The consequences of the interference caused by Mr Dunn’s actions were severe and accordingly, the protest is upheld.

Disqualification of BEAUDINE TERMINATOR, under the provisions of Rule 1003, was sought from the Stipendiary Stewards.  This application is granted and BEAUDINE TERMINATOR is disqualified from the race.
