Decision:

Following the running of Race 7, the Stewart Dawsons Jewellery Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr J. F. Curtin, driver of “Star Of Venus” (1), alleging a breach of Rule 869(3)(b).  The charge was that Mr Curtin drove carelessly when contacting the legs of “Yoggi Janis” (K. M. Barron) with approximately 600 metres to run.



Following the running of Race 7, the Stewart Dawsons Jewellery Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr J. F. Curtin, driver of “Star Of Venus” (1), alleging a breach of Rule 869(3)(b).  The charge was that Mr Curtin drove carelessly when contacting the legs of “Yoggi Janis” (K. M. Barron) with approximately 600 metres to run.

Mr Curtin had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.  Mr Curtin also agreed that he understood the Rule and the charge.

Mr Escott used video coverage to illustrate this incident.  Mr Curtin said that he thought he had been clear of Mr Barron’s horse when he had made this move.

Penalty:

--

In relation to penalty Mr Escott advised that Mr Curtin had no relevant previous convictions and had admitted the breach.  As this was a $20,000-00 race on a Premier Day a fine of $500-00 was recommended.  Mr Curtin thought that a

$500-00 fine was excessive.

We adjourned to consider the matter of penalty.  We were satisfied that it should be taken into account that this was a $20,000-00 race on a Premier Day.  To Mr Curtin’s credit we took into account his guilty plea and his clear record.

In all the circumstances we considered that a fine of $500-00 was appropriate and Mr Curtin was fined this amount.
