Following Race 4 an information was filed pursuant to Rule 876 (1) when it was alleged by Mr R Cameron, trainer of the 2nd horse PICARDO, that JUMERIAH JADE, placed 1st by the Judge, interfered with the chances of PICARDO, placed 2nd by the Judge.

DECISION AND REASON:

Following Race 4 an information was filed pursuant to Rule 876 (1) when it was alleged by Mr R Cameron, trainer of the 2nd horse PICARDO, that JUMERIAH JADE, placed 1st by the Judge, interfered with the chances of PICARDO, placed 2nd by the Judge. The interference was alleged to have occurred in the final 150 metres.

It was confirmed that all connections were informed of the protest.

Present at the protest were :

JUMERIAH JADE : Mr G Shaw - trainer, Mr N Harris - rider

--

PICARDO : Mr R Cameron and Mr G McCrae - trainers; Ms D Johnson - rider

The margin between 1st and 2nd was 1/2 a head.

--

Mr Cameron demonstrated the video films and showed in the last 150 metres Mr Harris moving out some horse widths and bump his horse PICARDO, causing Ms Johnson to stop riding. He believed that, with a margin of 1/2 a head at the post, this cost him the race.

Ms Johnson said she was bumped twice, lost momentum and it affected her chances of winning.

--

Mr Shaw, trainer of JUMERIAH JADE, said the horses came together and PICARDO laid in. He said Ms Johnson continued riding at all times.

Mr Harris, rider of JUMERIAH JADE, said it was a frivolous protest because Ms Johnson came in and made contact.

--

Stipendiary Steward Mr J Oatham, when asked for his assessment, said there was contact on two occasions with Mr Harris straightening immediately after the first contact and on the 2nd occasion it was of a minor nature and very close to the line.

DECISION

--

The Committee carefully considered all evidence and reviewed the video films.

--

Whilst we agree there was minor interference suffered by PICARDO and contact was made, this was contributed to by both horses. Also relevant to our decision was that the winner came from behind the 2nd horse, the 2nd bump was very close to the line and Ms Johnson did not stop riding at any time. Accordingly we believe the chances of PICARDO finishing in a better place were not affected and the protest is therefore dismissed.
