This is a protest lodged by Mr A Coles, Stipendiary Steward, alleging interference by VIENNETTA placed first by the Judge affecting the chances of SALSA placed third by the Judge in respect of New Zealand Bloodstock Breeder's Stakes, Group I, on 8 April 2006 at Te Aroha.

The protest was lodged pursuant to Rule 876(1) and seeks relegation of VIENNETTA.

--

Present at the hearing was P Hurdle, trainer/representative of VIENNETTA, rider D Bradley, Margaret Falconer trainer of SALSA and rider Leith Innes. All connections were made aware of the protest.

Mr J Oatham demonstrated on the head-on/side-on race films which showed VIENNETTA moved in 7 horse widths from the 300 metre mark to the finishing line dictating the line of SALSA ridden by L Innes when not sufficiently clear. Consequently SALSA was checked off the heels of VIENNETTA approximately 75 metres off the line. At the time of the interference SALSA was running in second position one length in front of ARLINGTONBOULEVARD. L Innes took corrective action in checking his mount.

Mr Innes rider of SALSA said his line was dictated for 300 metres. The interference caused by VIENNETTA cost his mount half a length at a critical stage of the race. He said that he had no doubt but for the interference he would have finished second.

Mr D Bradley gave evidence that the interference was minor and that Mr Innes had 300 metres to come on his outer. He admitted rolling in and said the best horse won on the day.

Mr P Hurdle, trainer of VIENNETTA, adopted Mr Bradley's statement.

The first question which we are required to consider is whether SALSA was interfered with and whether VIENNETTA caused that interference as alleged. We are satisfied that interference occurred.

It is necessary for us to consider whether that interference interfered with the chances of SALSA.

--

--

It is relevant to this consideration that SALSA lost momentum at a critical stage of the race, the margin at the finish between second and third was half a head. We find that VIENNETTA dictated the line of SALSA. We find that the chances of SALSA were interfered with by the interference of VIENNETTA.

We now have a discretion whether or not to place VIENNETTA behind SALSA. Taking into account the severity of the interference, loss of momentum at a critical stage of the race, relative placings of horses, the half head margin between second placing and third placing and consequences of relegation.

Accordingly it is our considered opinion that VIENNETTA should be relegated. The placings are therefore amended to:
