Decision:
Following the running of race number 8 an information was lodged by the Stipendiary Stewards under Rule 849 (2) alleging that I’m Easy was presented into the bird cage with the incorrect saddle cloth number.

Rule 849 (2) reads:
--“The trainer, horseman or person in control of each horse in the race shall ensure that the proper numbered saddle cloth is attached prior to the horse parading in the assembly area.”
----
At the outset of the hearing Mr Todd confirmed that he was acting on behalf of Mr D and Mrs C Butt and that the breach was admitted. Mr Renault said that Stipendiary Steward, Mr P Knowles, and himself were in the bird cage and as I’m Easy entered they both noted that the horse was wearing saddle cloth number 17, rather than saddle cloth number 14. The incorrect saddle cloth was removed and replaced with the correct saddle cloth prior to the race. The charge is found proven.

Mr Renault for the Stipendiary Stewards said that Mr and Mrs Butt had one previous offence under this rule on 20 April 2008 when they presented two horses into the bird cage in the same race with the wrong saddle cloth numbers.

Mr Todd said that he was in charge of the horses as the trainers were absent from the meeting. Prior to race 8 he had attempted to find a saddle cloth 14 for the horse but it was not available in the normal pick up area. He then asked associates to find the correct saddle cloth and they presented one to him which he put on the horse. He accepts that the saddle cloth number was incorrect.

The Stipendiary Stewards recommended a fine only and Mr Todd accepted that recommendation.

The Committee after taking into account the previous offence under this rule in the last twelve months, the early guilty plea and Mr Todd’s frankness, imposed a fine of $150.00.
