Following the running of Race 10, Wayne Francis Memorial New Zealand Oaks, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Public Trainer, Mr M Purdon, alleging that Mr Purdon, as the trainer of TOP TEMPO in the Race, presented that filly without the nasal strip

DECISION AND REASONS:

Following the running of Race 10, Wayne Francis Memorial New Zealand Oaks, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Public Trainer, Mr M Purdon, alleging that Mr Purdon, as the trainer of TOP TEMPO in the Race, presented that filly without the nasal strip with which the filly had raced at the meeting of New Zealand Metropolitan Trotting Club on 12 May 2007 in breach of the "12 day Rule".

Mr Purdon was present at the hearing of the information and admitted the breach.

Mr McIntyre told the Committee that TOP TEMPO had paraded in the birdcage prior to Race 10 without the nasal strip that she had raced in at the meeting of the Club last Saturday, 12 May 2007. He pointed out that the Race was a Group 1 event for a stake of $125,000. He referred the Committee to Rule 1114 (2) (a) & (b). He sought a fine of $200.

Mr Purdon explained that his stable had three horses in Race 8 as well as his brother's horse that was staying with him and another trained by Mr A G Herlihy. He said that he and his staff were "flat stick" with those five horses and having to get a load of horses away from the track. In addition, there had been false starts in Races 8 and 9 and the Club was having to make up time. He stated that he had intended to put the nasal strip on TOP TEMPO but it had simply been overlooked. The filly raced without the nasal strip. He submitted that a $200 fine for a nasal strip was "ridiculous".

Mr McIntyre said that he accepted the circumstances outlined by Mr Purdon and, in particular, that there had been a false start in Race 9 that had "shortened the gap" between Races 9 and 10.

The Committee considered the submissions of both parties. In arriving at penalty, the Committee took those submissions into account and in particular:
