An information lodged by Stipendiary Steward Mr J Muirhead against Junior Driver Mr C Sharpe, driver of HENRY POOTLE, alleging a breach of Rule 869 (3)(b) ? Careless Driving, in that he drove his horse carelessly causing it to strike the back of the sulky of GEOFFREY CLEMENT driven by Mr N Chalmers with about 450m left to run, HENRY POOTLE breaking and losing all chance. Mr Sharpe was assisted at the hearing by Senior Horseman Mr T Macfarlane. Mr Sharpe admitted the breach.

Mr Muirhead demonstrated the incident by use of the video film. KAHUNA BROMAC, driven by Mr P Hilliard, moved outwards from the marker pegs forcing GEOFFREY CLEMENT to race wider on the track. Mr Sharpe was looking for a gap which wasn?t there resulting in HENRY POOTLE striking the sulky of GEOFFREY CLEMENT and breaking. Mr Muirhead said that Mr Sharpe hadn?t exercised sufficient care and it was an error of judgement on his part. Mr Macfarlane agreed with Mr Muirhead's analysis.

PENALTY

Mr Muirhead said Mr Sharpe had a clear driving record and he recommended a two day suspension. Mr Macfarlane agreed with Mr Muirhead's recommendation as did Mr Sharpe. In fixing penalty I took into account the following :

  1. The guilty plea.
  2. --
  3. Mr Sharpe's clear driving record.
  4. --
  5. The submissions of Mr Muirhead and the acceptance of them by Mr Macfarlane and Mr Sharpe.
  6. --
  7. The offending was in the bottom half on the scale of seriousness.

Balancing those matters I suspended Mr Sharpe's horseman's licence for two days from the conclusion of racing on 18th May 2007 to the conclusion of racing on the 31st May 2007.
