Decision:

Following the running of Race 5, the $29-50 Friday Racenight Smorgasbord Pace, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 869(8).  It was alleged that “Fine Holmes” (2), which finished second in the race, had caused interference to “Nucifora” (9) with approximately 180 metres to run.



Following the running of Race 5, the $29-50 Friday Racenight Smorgasbord Pace, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 869(8).  It was alleged that “Fine Holmes” (2), which finished second in the race, had caused interference to “Nucifora” (9) with approximately 180 metres to run.

Mr D. J. Butt and Mr G. Hall, the driver and trainer of “Fine Holmes”, attended the hearing.  Mr C. J. De Filippi, the driver of “Nucifora”, also attended the hearing, and he advised that he would represent the connections of that horse.

Stipendiary Steward Mr Renault used video coverage to show that with about 180 metres there was contact between “Nucifora” and “Fine Holmes” with the latter horse breaking and losing its chance.

Mr De Filippi gave evidence that there had been contact as shown in the video coverage, but that he did not attribute this solely to Mr Butt’s horse.  He said that it was a 50/50 call.

After viewing the video coverage several times, and after hearing the evidence from Mr De Filippi, Mr McIntyre made an application to withdraw the protest.  Accordingly leave was given for this Information to be withdrawn, and the Judge’s places were confirmed.
