Decision: Following the running of Race 5, “Woodend Hotel” Rangiora Winter Three-Year-Old Stakes, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr M P Jones, alleging that Mr Jones, as the driver of LAVROS CONQUEST in the Race, “forced ALRIGHT NOW (J R Dunn) to race wider on the track

DECISION AND REASONS:

Following the running of Race 5, “Woodend Hotel” Rangiora Winter Three-Year-Old Stakes, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr M P Jones, alleging that Mr Jones, as the driver of LAVROS CONQUEST in the Race, “forced ALRIGHT NOW (J R Dunn) to race wider on the track with approximately 1300 metres to run”, in breach of the push-out Rule.

Mr Jones had signed the Statement by the Defendant endorsed on the information form to the effect that he admitted the breach of the Rule and, further, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Mr McIntyre showed the incident on side-on and head-on video replays. He pointed out LAVROS LODGE racing three back on the outside. Mr Jones looked around and was entitled to come out well prior to when he did. Mr Dunn then improved on ALRIGHT NOW and got outside the wheel of LAVROS CONQUEST before Mr Jones came out and forced ALRIGHT NOW to race 4-wide. Mr Jones was entitled to come out but simply left it too late to do so, Mr McIntyre said. The Committee was satisfied that it was a clear breach of the push-out Rule.

In relation to penalty, Mr McIntyre informed the Committee that Mr Jones has had 953 drives in the current season and has not previously breached the push-out Rule. He recommended a fine of $200.

The Committee took into account Mr Jones’ admission of the breach and his previous good record.

Mr Jones was fined the sum of $200.
