Decision: -- An information filed by Stipendiary Steward Mr J Muirhead against Mr G Small, trainer of TINTIN IN AMERICA, alleging a breach of rule 858(a) and (b) in that he presented his horse into the assembly area and on to the track with 9 minutes to go to start time. Mr Small denied the charge and was present at the hearing. Mr Muirhead said he was in the parade ring when TINTIN IN AMERICA was presented there with only 9 minutes to go to race start time. He said Mr Small had no horses in the previous race. Mr Small did not cross examine Mr Muirhead. Mr Small said he had owners of horses which were due to race with him. He had instructed a staff member to take the horse to the latrine. The horse was bought back and was about to be put into the sulky. He asked if the horse had used the latrine and was told 'no'. Mr Small said he then took the horse himself to the latrine, there was a queue, but the horse did go and he then put it in the cart and took it to the assembly area, DECISION: This is a straight forward matter. Mr Small has not given any evidence which contradicts the evidence of Mr Muirhead or establishes that he has not breached the rule. He has simply given evidence about mitigating factors and in addition shown that better organisation on his part would have avoided this matter proceeding as it has. The charge is proven. PENALTY: Mr Muirhead recommended the standard penalty of $100. Mr Small thought that was severe and was critical of the Stipendiary Stewards pursuing trainers for being late into the assembly area.
