Decision:

An information was filed following race number 4 instigating a protest.  This protest alleged a breach of  Rule 870 & Sub-clauses, also the breaking horse regulations.

The informant was Mr J M Muirhead who alleged that horse No 4 Sunny’s Bar (Mr E Brosnan) was in breach of the rules in that this horse had galloped in excess of 150 meters at the start of this race.

The informant was Mr J M Muirhead who alleged that horse No 4 Sunny’s Bar (Mr E Brosnan) was in breach of the rules in that this horse had galloped in excess of 150 meters at the start of this race.

The judges placings for this race were 1st No 1, 2nd No 9, 3rd No 6, 4th No 4, 5th No 5, 6th No 3.

 Mr E Brosnan,  Jr Horseman, was present at this hearing and stated that he was representing the connections of this horse in this hearing.   Mr Brosnan also stated that he understood the  rules pertaining to this hearing.

Mr Muirhead showed the start of this race by way of the video and this clearly showed Sunny’s Bar to gallop off the mark and still be in a gallop at the pylon which marks 150 meters after the start.  Mr Brosnan when asked for his evidence stated that his horse was in its incorrect gait for in excess of 150 meters after the start of this race.

Decision and Reasons.

--

Having heard the evidence of Mr Muirhead and Mr Brosnan, and also watched the video of the start of this race this Judicial Committee finds that Sunny’s Bar was in breach of Rule 870 and the breaking horse regulations.  It was clear that Sunny’s Bar did gallop for a distance in excess of 150 meters.

The Protest is upheld and this Judicial Committee orders that Sunny’s Bar be disqualified from 4th place in race number four under the provisions of Rule 1003.

The amended placings shall now be  1st No 1, 2nd No 9, 3rd No 6, 4th No 5, 5th No 3, 6th No 2.
