Following the running of Race 1, Couplands Bakery Trot, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr M R De Filippi, alleging that Mr De Filippi, as the driver of KIWI SERENE in the Race, failed to activate the removable hood on that mare.

DECISION AND REASONS:

Following the running of Race 1, Couplands Bakery Trot, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr M R De Filippi, alleging that Mr De Filippi, as the driver of KIWI SERENE in the Race, failed to activate the removable hood on that mare.

Mr De Filippi was present at the hearing of the information and advised that he admitted the breach. The breach was found proved.

Mr Escott showed a video replay of the final stages of the Race. He pointed out KIWI SERENE running 2nd nearing the finishing line. He said that Mr De Filippi's explanation was that his mare was not "trotting squarely". Mr Escott pointed out that all gear that is removable is required to be removed. He submitted that Mr De Filippi was well aware of the horse's racing tendencies and should have sought consent to race it in a fixed hood. This would leave no doubt on the part of the Stipendiary Stewards or the betting public.

Mr Escott recommended a fine of $100.

In explanation Mr De Filippi stated that the horse trotted very roughly down the straight. He feared that, had he pulled the removable hood, the horse would have galloped. He felt that, in not removing the hood, he was doing the best for the horse and the punter.

The Committee took into account Mr De Filippi's admission of the breach and his explanation.

Mr De Filippi was fined the sum of $100.00
