Following the running of Race 1,the Canterbury Draught Maiden, Mr AB Taggart was charged with careless riding pursuant to Rule 871(1)(d).
| -- Decision & Reasons --Following the running of Race 1,the Canterbury Draught Maiden, Mr AB Taggart was charged with careless riding pursuant to Rule 871(1)(d). --It was alleged that Mr Taggart had let his mount OKI OSKAR shift outwards when not sufficiently clear causing interference to EYE CANDY (B Hibberd) . --Mr Taggart pleaded guilty to the charge. --Video evidence from the head on and side on cameras was shown. --The head on film, in particular,showed a distinct outward movement on the part of Mr Taggarat's mount, with contact being made with EYE CANDY. --It was generally agreed by Mr Ching and Mr Taggart that the incident comprised three movements. --Mr Taggart told the hearing that he had looked back about 50 metres before the incident and did not see Mr Hibberd, but conceded that his carelessness was based on not looking back again when starting his outward movement. --PENALTY --Mr Ching submitted that the carelessness on Mr Taggart's part could have led to a dangerous situation and that a suspension was called for. Mr Ching acknowledged that Mr Taggart has a good record and should receive credit for his guilty plea. Mr Ching also conceded that Mr Taggart's mount is a big awkward horse that races "greenly". --MR Taggart felt that his carelessness was "medium". --Careless riding almost always compromises the safety of other riders. For that reason, suspension is the starting point in terms of assessing penalty. --I have carefully considered whether any other penalty can be imposed such as a fine or a suspension and fine. My conclusion in this instance is that a suspension is the only penalty that can be imposed. --The period of suspension for careless riding is often in the region of 3 to 5 days, depending on the circumstances of the case. However, in this instance, because of the mitigating features, ie., Mr Taggart's early guilty plea and his good record, I am prepared to allow a discount on penalty. I have alsonot overlooked the awkwardness of the horse. --The period of suspension will therfore be 2 days. --Mr Taggart is suspended from the conclusion of racing on Sunday 3rd October 2004 until the conclusion of racing on Friday 15th October 2004. ---- -- -- -- -- -- -- -- -- -- -- -- --
