An Information was laid by Stipendiary Steward Mr T TAUMANU against Driver Mr F COONEY alleging he breached Rule 869(4) and The Passing Lane Regulations

An Information was laid by Stipendiary Steward Mr T TAUMANU, against Driver Mr F COONEY, alleging he breached Rule 869(4) and The Passing Lane Regulations during the running of Race 6 in that being the driver of AQUA BLAST had allowed his horse to move in when in the lead during the run home, impeding ANALYST (T MITCHELL) which had to be restrained and losing momentum at a crucial stage of the race.

Mr Cooney admitted the breach and was present for the Hearing. Both parties consented to the admission of evidence adduced at an earlier protest hearing into the running of the same race.

This clearly showed Mr Cooney caused interference to the progress of ANALYST during the run home when his drive leading at the turn for home moved into the passing lane impeding progress of ANALYST.

The charge was established and Mr TAUMANU in submissions on penalty said that Mr COONEY had a virtually faultless driving record and had openly admitted his breach. However the race was one of 6 Heats in the NRM Sires Stakes for 3 year olds and taking into account the status of the race requested a two week suspension.

Mr COONEY suggested he would prefer a fine but elected not to make submission to that effect. He asked for consistency in the ruling on suspension.

Taking into account the matters raised by both parties including the driving record and early plea of guilty Mr COONEY was suspended for 2 weeks following the conclusion of racing on 23rd September until the conclusion of racing on the 6th October 2005.
