Decision:
Following Race 1 an Information was filed by the Informant, John Oatham, pursuant to Rule 871(1) (d). He alleged that Ms Spratt allowed her mount “Yeah Barbie” to shift inwards near the winning post on the first occasion when not sufficiently clear of “The Grogoch” (M Walker) who was forced inwards causing severe checks to “Nothing but the truth” (C Grylls) and “All Cash” (D Johnson)

Initially Ms Spratt did not admit the breach but subsequently changed her plea to guilty.

Mr Coles demonstrated the video films which showed Ms Spratt, riding “Yeah Barbie”, move in towards the rail. She was not the required distance clear of The Grogoch (M Walker) which was forced inwards with resultant bad checks to “Nothingbutthetruth” and “All Cash”.

Mr D Johnson, rider of “All Cash”, confirmed she had received a severe check as a result of crowding from the outside, as did Mr Grylls, riding “Nothingbutthetruth”

PENALTY SUBMISSIONS

Mr. Oatham said Ms Spratt had incurred 6 charges in the last 12 months but that lately her record had improved considerably. He said this was at the mid to high end of carelessness and submitted 6 – 8 days would be appropriate.

Ms Spratt confirmed she had no firm commitments and asked for any suspension to start immediately.

The Committee considered all submissions and evidence and before imposing a fair penalty took into account the following:

Accordingly we impose a suspension to start after racing today, January 25 and conclude after racing on February 5, 2009 (7 days)
