CHARGES:
--Mrs Neal appeared before the committee on a charge of using her whip excessively on Doctor Kovac over the concluding stages of Race 10 of the Auckland Trotting Club meeting of the 18th June 2010. The information was completed and lodged on race night with the registrar and endorsed by Mrs Neal admitting the breach. She was present for the hearing.

FACTS:
--Mr Muirhead referred to video footage of the concluding stage of the race which showed at least 26 strokes of the whip by Mrs Neal on Doctor Kovac.

SUBMISSION(s) ON PENALTY:
--Mr Muirhead submitted that a fine of $250 was that recommended in the penalty guidelines. He told the hearing that the meeting was a premier event and although the blows were not hard they were continuous and the number was clearly excessive. He considered the offending mid range and said Mrs Neal had no breaches in the previous 12 months

Mrs Neal asked for leniency in support telling the committee she had a bad whipping style and that her action did not mark the horse in anyway. She was aware of the guidelines requiring pauses in whipping action.
