Following the running of Race 3, the www.ashburton.co.nz Handicap Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Junior Horseman Ms K. M. Burgess, the driver of “The Perfect Drive” (3), alleging a breach of Rules 869(4), (6)(b) and (c), the “push out” rule. It was alleged that Ms Burgess shifted outwards about the 1600 metre mark, and in doing so caused “Bunyula Fella” (4) to race three wide.

Following the running of Race 3, the www.ashburton.co.nz Handicap Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Junior Horseman Ms K. M. Burgess, the driver of “The Perfect Drive” (3), alleging a breach of Rules 869(4), (6)(b) and (c), the “push out” rule. It was alleged that Ms Burgess shifted outwards about the 1600 metre mark, and in doing so caused “Bunyula Fella” (4) to race three wide.
--Ms Burgess had indicated on the Information that this breach of the Rules was admitted, and that she did not wish to attend the hearing.
--During the preliminary enquiry into this matter by the Stipendiary Stewards, Ms Burgess was assisted by Mr D. J. Butt, a senior horseman. Ms Burgess had advised at this hearing that she would prefer a suspension to a fine.
--It was also established that Ms Burgess had very few drives. The recommended period of suspension was from after the completion of racing on 10 December 2009, until after the completion of racing on 17 December 2009, which was one week. This period included four race meetings where Ms Burgess might have been driving.
--We adjourned to consider the matter of penalty. We were satisfied that Ms Burgess has very few race day drives. The one week suspension period recommended includes race meetings at Forbury Park on 11 December 2009, Methven on 13 December 2009, Invercargill on 15 December 2009 and Addington on 17 December 2009. Potentially Ms Burgess could drive at these meetings.
--We considered the one week suspension to be an appropriate penalty in the circumstances. Accordingly Ms Burgess was suspended from after the completion of racing on 10 December 2009, until after the completion of racing on 17 December 2009 (four days).
