DECISION AND REASONS:

Following the running of Race 3, the PGG Wrightson NZ Yearling Sales 2YO Trot, an information instigating a protest was laid by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 869(8). The information reads as follows.

"This is a protest by horse number (10) placed 7th by the judge against horse number (2) placed 5th by the judge on the grounds of interference shortly after the start."

Rule 869(8) reads as follows.

--

"The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:

--
    ------
      --
    1. may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
    2. --
    3. may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
------

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

--

Trainer S.L McCaffrey indicated on the information that he did not contest the protest.

--

Mr McIntyre gave evidence by way of the video replay that showed Harvey Krumpet breaking shortly after the starting point was reached and galloping outwards taking the line of Lady Midnight and causing that filly to break, losing considerable ground.

--

After hearing the evidence the committee relegated Harvey Krumpet behind Lady Midnight.
