Mr MacDonald we?ve heard Mr Young and Mr Forbes give evidence at the earlier protest which you?ve agreed can be considered for the purposes of determining this charge, that Mr Forbes was 1 out from the fence when you moved out gradually pushing him from 2 to 3 wide.

Mr Young has said that you kept coming and contact was made between the legs of TAKE THE CASH and your wheel. Mr Forbes said he was merely endeavouring to maintain his position. ----Mr MacDonald you?ve disputed the fact that you pushed out Mr Forbes saying you were never on the fence and were 1 out following Mr Williamson when the incident occurred. ----Mr MacDonald we prefer the evidence of Mr Forbes and Mr Young. We are satisfied that Mr Forbes was indeed 1 off the fence and was being followed by Mr Young who was some little distance behind. The video evidence clearly demonstrates the head of your horse inside the sulky wheel of Mr Williamson when you were still following the leading horse. Over a distance of some 30 to 40 metres you moved into the 1 out line with the intention of following Mr Williamson. Unfortunately in moving out you pushed Mr Forbes 3 wide with the consequence that as the horses rounded the bend TAKE THE CASH broke when a leg came into contact with your sulky wheel. We are satisfied that the movement, as the witnesses state and Mr Escott alleges, is from the inside out, and not the converse, as you state. The videos, whilst not entirely conclusive, support the evidence given by Mr Young and Mr Forbes. In these circumstances and with interference being caused to TAKE THE CASH, we find the charge of careless driving proved. ----Penalty ----Mr MacDonald your record is clear. You have no previous breaches of this Rule. Mr Escott has asked that you be disqualified up to and including the 14th of October. We believe this recommendation to be very realistic having regard to the circumstances of the breach. We note that your intention, as expressed at this time, is that you would only drive on the grass tracks at Motukarara and Methven. You are disqualified up to and including the 14th of October. This is in effect 4 days, with Addington being a Premier meeting at which you are not eligible to drive. ----Chairman ---- |
