Following the running of Race 10, Avon City Ford Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Trainer, Mr W E Higgs, alleging that Mr Higgs, as the trainer of TOTALLY DIFFERENT in the race, failed to affix the nasal strip to that horse

DECISION AND REASONS:

--

Following the running of Race 10, Avon City Ford Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Trainer, Mr W E Higgs, alleging that Mr Higgs, as the trainer of TOTALLY DIFFERENT in the race, failed to affix the nasal strip to that horse as notified to the Club as a gear change.

Mr Higgs admitted the breach.

Mr Escott sought a fine of $200 based on Mr Higgs' guilty plea. The horse had raced in Race 10 without the nasal strip, Mr Higgs having earlier advised the Club that it would race in one.

Mr Higgs informed the Committee that this was the first time he had used the nasal strips. He said that he had no obligation to do so, but he had advised the Club that three of his starters would be wearing them. He was aware that this would have been advised to the newspapers. He explained that he had put the nasal strips himself on the first two runners from his stable. Mr Higgs said that he had been under pressure immediately after Race 9, New Zealand Trotting Cup, to gear up his runner for the next race and he had overlooked putting the nasal strip on TOTALLY DIFFERENT for Race 10.

The Committee delivered the following decision in relation to penalty:

--

"Mr Higgs, your candidness in admitting the breach is appreciated. However, we do accept the recommendation for the penalty in this particular case. We note that there are no previous matters and you have pleaded guilty. However, we are still of the view that the recommended fine of $200 is appropriate and you will be fined that sum, $200.
