In Race 9, as a result of an incident approximately 200 metres from the finish, Mr J C Bates, the rider of WAITUI GOLD was charged with careless riding pursuant to Rule 871 (1)(d).

Mr Bates pleaded guilty to the charge, which is therefore deemed to be proved.

Assistant Stipendiary Steward Mr McLaughlin demonstrated the incident on the video coverage. It showed Mr Bates competing strongly for the finish but in the process, when using the whip, his horse moved sideways on to SPONGE BOB ridden by Ms Ashlee Mundy. Mr Bates corrected his line immediately but upon resuming, the horse moved over again, forcing Ms Mundy's mount on to the hind quarters of DIVERTIMENTO, ridden by Mr C Grylls.

In response, Mr Bates said that he did not dispute the fact situation. He said he heard Ms Mundy call out to him but that he carried on riding. He said that he had the inside rein pulled tight but that did not prevent his mount from moving sideways. He acknowledged that he should have taken stronger corrective action.

Mr Ching advised the hearing that Mr Bates had a good riding record, having been charged pursuant to this rule only once in the last year or more. On 4 January 2007, he was given a two day suspension and fined $350.

He felt that Mr Bates' degree of carelessness was middle range, and called for a suspension of between two and five days. In response to a question from the Chairman, as to whether or not there was any horse error involved in the incident, Mr Ching observed that a rider has an obligation to keep his horse on a true line. Had he been making such a true endeavour, then the charge would not have been brought.

In response to the submissions by Mr Ching, Mr Bates emphasised that he believed he did have a good riding record, but acknowledged that a suspension did have to be imposed. He also agreed that a fine should be imposed. He pointed out that his wife is expecting their second child.

He also confirmed to the hearing that he does not ride in the North Island.

PENALTY DECISION

--

After considering all matters including Mr Bates' personal domestic circumstances, we consider that an appropriate penalty in this instance is a two day suspension together with a fine. Rider safety was involved as Ms Mundy was forced onto the hind quarters of Mr Grylls' mount.

Accordingly, Mr Bates is suspended from race riding from the conclusion of racing on Friday 11 May 2007 until the conclusion of racing on Saturday 26 May 2007. He is also fined the sum of $400.
