Decision:

Jockey B Herd admitted a breach of rule 866 (1) (c) in that he failed to ride “Hot Deputy” out to the finish of the race.



Jockey B Herd admitted a breach of rule 866 (1) (c) in that he failed to ride “Hot Deputy” out to the finish of the race.

The rule was read and Jockey B Herd confirmed he understood the rule and confirmed he admitted the breach.  Stipendiary Steward R. Neal used the available films to point out the incident.  There was doubt that “Hot Deputy” would have run fourth but there was a strong possibility of Jockey B Herd’s mount finishing in a higher placing.

“Hot Deputy” was on the inside and the available films confirmed Jockey B Herd standing up short of the line and stopping riding.

Jockey B Herd was unaware of the incident until it was pointed out to him by the Stipendiary Steward and confirmed that it did look terrible.   He is a senior jockey and it was a major lack of judgment.

Stipendiary Steward Goodwin told the committee the stewards had viewed the incident at length, they gave Jockey B Herd the benefit of the doubt of the horse finishing fourth and the charge laid was less serious than what it could have been.

It was a co-mingling race and he asked for a fine in the vicinity of $500.00 to be imposed.

Jockey B Herd informed the committee that he concurred with Stipendiary Steward Goodwins comments.

In coming to our decision to impose a monetary penalty, we have taken into account your admittance of the breach and your comments about the incident where you stated it did not look good and was something that was not expected from any jockey, let alone a senior rider of your experience.  This committee fines you the sum of $500.00.
