Following the running of Race 6, the Addington Events Centre Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren alleging a breach of Rule 870(4)(d) by “King Coaster Anvil” (4) which finished 3rd in the Race.



Following the running of Race 6, the Addington Events Centre Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren alleging a breach of Rule 870(4)(d) by “King Coaster Anvil” (4) which finished 3rd in the Race.

Present at the hearing were Mr R. Bromley, son of the trainer Mr J. Bromley the trainer of “King Coaster Anvil” (4), and Mr R. T. May the driver of that horse.

The Information reads as follows.

--

“This is a protest against horse number (4) placed 3rd by the Judge on the grounds of breaking from its gait Rule 870(4)(d).”

Rule 870(4)(d) provides as follows.

--

“(4) Any horse which breaks from its gait in any race and:-
 (d) which fails to lose ground in the break;

--

may (in addition to any other penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horse Regulations made by the  Executive, be placed by the Judicial Committee  immediately after any other  horse in respect of which any advantage may have been gained.”
 
Stipendiary Steward Mr Ydgren gave evidence and used video coverage to show that “King Coaster Anvil” paced away at the start of the race, but went into a break shortly after.  It was then in a break for about 100 metres before regaining its proper gait.  It was then able to settle in the one out and one back position.  Mr Ydgren said that the horse did not lose ground in the break as required by the Rules, and that it should therefore be relegated.

Mr May did not agree that his horse failed to lose ground, and he used the video to illustrate his point.  He said that he did lose ground to one or two of the front running horses.

After hearing the evidence we adjourned to consider our decision.  We were satisfied that “King Coaster Anvil” broke from its correct gait shortly after the start and continued on in a break for about the next 100 metres.  While it was in a break it may have lost a little ground on one or two horses shortly before it regained its correct gait.  However we were satisfied that it failed to lose ground to most of the field.  We were satisfied that the protest should be upheld.

On returning to the Enquiry Room we advised the parties of our decision. Accordingly “King Coaster Anvil” was relegated to last place.  The amended places were then as follows.
